OFFICIAL RULES – SMOKE INN™ SERIES OF POKER TOURNAMENT
U.S. LAW AND LOCAL LAWS AS APPLICABLE IN EACH JURISDICTION GOVERN THIS PROMOTION.
1.GENERAL: The Promotion is sponsored by Smoke Inn II, LLC (“Sponsor”). These are the official rules (the “Official Rules”) for “SMOKE INN™ SERIES OF POKER® TOURNAMENT” (the “Promotion”).
2.PURPOSE: SMOKE INN wishes to sponsor a contestant for the 2017 World Series of Poker (“WSOP”) in Las Vegas, Nevada. In order to determine the contestant to represent SMOKE INN at the WSOP (the “Smoke Inn Contestant”), the Sponsor is holding the Promotion.
3.Due to the limited spaces available, entry will be limited to the first 150 entrants to purchase a Smoke Inn Series of Poker Duffle Bag (Cigar Package) from one of the participating cigar manufacturing sponsors.
4.ELIGIBILITY: The Promotion is open only to legal residents of the fifty (50) United States and Washington, D.C. who are twenty-one (21) years or older as of the date of Tournament (a “Participant”). A valid Picture ID is required upon entry on the day of the tournament. The Promotion is void in all U.S. Territories (e.g., Guam, Puerto Rico, USVI’s) and where prohibited by law. Participation in the Promotion constitutes participant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions. The decisions of the Sponsor with regard to all matters of this Promotion are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
5.HOW TO REGISTER: Purchase of the Cigar Package reserves buyer a seat in the tournament. Only one seat per participant is allowed. Cigar Package may be purchased online at www.smokeinnseriesofpoker.com There are only 150 Cigar Packages and they will be sold to the first 150 who make the purchase. It is each participant’s sole responsibility to be certain that the information on the entry form and correct. Sponsor shall not be responsible for incomplete registration forms. By registering, you may automatically be added to the Sponsor’s e-mail distribution and regular mailing lists. For information on how to opt-off the Sponsor’s e-mail distribution list, see the Privacy Policy posted on the Website or click on the link in the e-mail distributed by Sponsor. For removal from Sponsor’s regular mailing list, see Rule #19, below. Opting-off the e-mail distribution list or regular mail list will not affect your ability to participate or win. The information you disclose when you register will be subject to the Privacy Policy (Available upon request or on the Smoke Inn Website at: www.smokeinn.com).
6.Mail-In Entry: Not applicable.
7.TEXAS HOLD’EM POKER (the “Game”) / HOW TO PLAY THE TEXAS HOLD’EM POKER:
a.The Game is “No Limit” Texas Hold’Em Poker. No other Poker Games will be played.
b.Upon registration each player shall receive Chips worth 6000 points with which to play in the Tournament. Chips cannot be sold, bartered, traded or combined, assigned or transferred, have no cash or credit value, cannot be redeemed for cash or credit, and can only be used as is consistent with these Official Rules.
c.The objective of Texas Hold’Em Poker is to use the two (2) facedown cards you are dealt, along with the five (5) community cards, to make the best Poker Hand. Complete rules on how Texas Hold’Em Poker will be available at the Tournament Location or you can ask for a copy of the rules at any Smoke Inn Location. The participant that makes the best five-card Poker Hand at the end of the four (4) Rounds wins that Game Hand and the total amount of Chips bet in that Hand. The “Dealer” for each Hand and will change position moving in a clockwise direction around the Table at the end of each Hand. Before the cards are dealt, the participant to the immediate left of the Dealer is required to post the small blind and the participant to his/her left is required to post the big blind. The small blind is half of the lower betting limit. The big blind is the full lower betting limit. The first two cards are dealt to each player facedown (the “pocket cards”). The person to the left of the big blind starts the first Round of betting. Each Hand will proceed in accordance with the Game rules.
d.These rules are subject to interpretation, expansion, and modification as by the person designated by Sponsor to oversee the Tournament (the “Tournament Director”) as needed. Any such change or modification shall be at the sole discretion of the Tournament Director. All decisions and rulings of the Tournament Director shall be final, binding and cannot be appealed or overruled except by the Sponsor.
8.Tournament Winner. The games of play shall continue until all but one participant has been eliminated, at which point the Tournament shall be deemed concluded. At the conclusion of the Tournament, the participant with the most accumulated Chips will be deemed the Provisional Tournament Winner. Upon verification of eligibility, the Provisional Tournament Winner will be awarded the Grand Prize, which includes the opportunity to be a WSOP tournament contestant (the “Smoke Inn Contestant”) in the 2017 World Series of Poker in Las Vegas.
9.Grand Prize Package.
a.The Tournament Winner shall award one grand prize package consisting of:
i.Coach roundtrip airfare to Las Vegas for the Smoke Inn Contestant on an air carrier chosen by the Sponsor, departing from a major airport in the continental United States;
ii.Accommodations for 5 days and 4 nights at a Las Vegas hotel as chosen by the Sponsor;
iii.10,000 tournament entry fee payable to the WSOP.
b.The Grand Prize Package shall be valued at $12,000 including the $10,000 WSOP tournament fee, not including applicable federal withholding taxes.
c.Winner is responsible for the payment of any applicable federal tax on the value of the Grand Prize Package.
10.Smoke Inn Contestant Rules.
a.Tournament Winner agrees to play in the 2017 World Series of Poker (the “World Series”) as the Smoke Inn Contestant. By accepting the Grand Prize Package the Smoke Inn Contestant agrees to the following while in Las Vegas for the World Series during all play in the World Series. Should winner fail to comply to the following terms, he/she will then be found in breach of the agreement and responsible to return the $10,000.00 entry fee paid by Smoke Inn. Contestant shall at all times:
i.wear assigned manufacturer’s shirt provided by Sponsor;
ii.wear Smoke Inn hat provided by Sponsor; and
iii.carry and use a cigar (provided by Sponsor) as a prop while playing in the World Series.
11.Tournament Travel Restrictions.
a.The Smoke Inn Contestant agrees to accept the travel plans arranged on the contestant’s behalf for the sole purpose of appearing as a contestant on the tournament date(s) designated by the WSOP.
b.The Smoke Inn Contestant is responsible for all other expenses not listed in section 9, including meals, ground transportation and incidental expenses.
c.No portion of the travel prize, tournament entry fee or applicable taxes paid by the Sponsor shall be redeemed for any other value other than its intended purpose.
d.The Sponsor shall not be responsible for cancelled or delayed travel, or subsequent disqualification from WSOP tournament play, due to causes beyond their control, including but not limited to:
i.Inclement weather; ii. Act of God; iii. War; iv. Civil disturbance; v. Acts of Terrorism; vi. Actions by the WSOP; vii. Court order; or viii. Action of air carrier.
e.Any unused portion of the Grand Prize Package is non-refundable.
12.WSOP Tournament Rules.
a.Contestants competing in the WSOP tournament shall be 21 years of age or older
b.Contestants shall adhere to all applicable WSOP tournament rules.
c.Contestants are responsible to appear at all WSOP designated times and locations.
d.The Sponsor is not responsible for any WSOP decisions regarding tournament play or disqualifications.
13.Payment of WSOP Tournament Winnings.
a.Tournament contestants are responsible for all taxes due on prizes won during tournament play.
b.Tournament prizes are paid by the WSOP and in accordance with their payment procedures and policies. The Sponsor shall not be responsible for the payment of any prizes won during tournament play.
c.Tournament prize amounts are determined by the WSOP.
14.CONSUMER DISCLOSURE: GRAND PRIZE there shall be one [1] Tournament winner, who shall have the opportunity to enter as a contestant in the 2017 World Series of Poker as the Smoke Inn Contestant. The Tournament winner may not assign or transfer the prize. All prizes will be awarded.
15.GENERAL CONDITIONS: By entering and participating, (a) participants agree that SMOKE INN, LLC, its parent, affiliates, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents are indemnified, released and will be held harmless by participants from any and all liability, for any damages, injuries or losses of any kind to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of prize or his/her participation in the Game or Tournament or any Game or Tournament-related activity; and (b) WINNER agrees to abide by the requirements of Rule 10 above and grants (and agrees to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information at any time or times for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide and on the World Wide Web, without review, notification, approval or additional compensation, unless prohibited by law. The Smoke Inn Contestant must be at least twenty one (21) years old and is subject to age verification and such other verification as solely determined by Sponsor. The Provisional Grand Prize Winner will be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where lawful, a Publicity Release within ten (10) days of being declared the provisional winner. If the winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize will be forfeited and an alternate winner selected. The sole responsibility for any irregular Round or Hand, as solely determined by Sponsor, is replacement with another Round or Hand during the Game Period. Federal, state and local income and other taxes on the prize, if any, are solely the responsibility of the Winner.
16.LIABILITY LIMITATIONS: Sponsor, its agencies, and web masters/suppliers are not responsible for lost, late, misdirected, non-delivered entries, Game Rounds or Hands, Chips, Sponsor, its agencies, suppliers are not responsible for any incorrect or inaccurate information, whether caused by Sponsor its employees, or by any equipment or programming associated with or utilized in this Promotion and assume no responsibility for any error, omission, interruption, deletion, defect or delay in. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the process or operation of Game or Tournament to be acting in violation of the terms of these Official Rules or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. If, for any reason, the Promotion is not capable of running as planned, in the sole opinion of the Sponsor, fraud, technical failures or any other causes which, in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion, or any part of the Promotion, and award the prize(s) in a manner deemed fair and appropriate by Sponsor.
17.IN NO EVENT WILL SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR RESPECTIVE ADVERTISING OR PROMOTION AGENCIES, OR ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE PROMOTION. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE RIGHT IS RESERVED TO SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
18.DISPUTE RESOLUTION/CHOICE OF LAW: Except where prohibited, by participating, participant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor, shall be governed by and construed exclusively in accordance with the laws of the State of Florida without giving effect to any principles of conflicts of law of any jurisdiction. You agree that any action at law or in equity arising out of or relating to this Promotion shall be filed only in the state courts located Palm Beach County, Florida, and Participant hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating, Participant agree that:
a.any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action;
b.any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating, but in no event attorneys’ fees; and
c.under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
d.Any Promotion materials including, without limitation, the offer, these Official Rules, advertising and promotional materials and announcement(s) of the Tournament Winner containing production, printing or typographical errors or obtained outside authorized, legitimate channels are automatically void; and the liability of Sponsor, if any, is limited to the replacement of such materials and recipient, by participating, releases Sponsor, its parent, subsidiaries, advertising and promotion agencies, the judging organization and their respective officers, directors, employees and agents from any and all losses, claims or damages that may result therefrom. Any inconsistencies between any advertising or other promotional announcements and these Official Rules shall be resolved in favor of these Official Rules.
19.REMOVAL FROM MAILING LIST: To have your name and address removed from Sponsor’s mailing list, send a post card with your name & address to “Abe” at: SMOKE INN, 801 Village Blvd. Ste. 305, West Palm Beach, FL 33409 asking that you be removed from the customer database. Alternatively you may send an email with the same information to: remove@smokeinn.com. Your name and address will be removed from Sponsor’s mailing list within sixty (60) days after receipt of your request, after which time no further mailings will be sent to you.
20.WINNER’ LIST: A list of the names of the Tournament Players and Winner (available upon completion of the Tournament), will be posted on the website www.smokeinnseriesofpoker.com

ALL PARTICIPANTS MUST CERTIFY THAT THE FOLLOWING STATEMENT IS TRUE:
“I certify that I am at least twenty one (21) years old and that I have entered the SMOKE INN SERIES OF POKER TOURNAMENT and won the grand prize. I have read and understand the official rules and I agree to abide by the Official Rules. I understand that giving false information in order to enter the Tournament may constitute a violation of law.”
